Fireworks - General Reminder on Use

Recently, the Chambersburg Police Dept. has responded to a number of incidents of fireworks being set off next to occupied structures and areas that are prohibited:  As the 4th of July holiday approaches, the Chambersburg Police Dept. would like to remind the public that the following prohibitions apply to fireworks, particularly "Consumer Fireworks":

A person may not intentionally ignite or discharge: (1)  Consumer fireworks on public or private property without the express permission of the owner. (2)  Consumer fireworks or sparkling devices within, or throw consumer fireworks or sparkling devices from, a motor vehicle or building. (3)  Consumer fireworks or sparkling devices into or at a motor vehicle or building or at another person. (4)  Consumer fireworks or sparkling devices while the person is under the influence of alcohol, a controlled substance or another drug. (5)  Consumer fireworks within 150 feet of an occupied structure.   The term "Consumer Firework" does not include devices such as "ground and hand-held sparkling devices," "novelties" or "toy caps"

Persons who violate the above prohibitions are subject to Summary Arrest and a fine of up to $100.00.   Additionally, the police may confiscate the fireworks and the owner shall be responsible for costs of the storage and eventual destruction.
